Last Will and Testament
Purpose
This document specifies how you want your assets distributed after your death, names an executor to manage your estate, and can appoint a guardian for minor children.
Requirements (Florida)
Signed: Signed by you, the testator, or by someone else in your presence and at your direction.
Witnessed: Signed by at least two competent witnesses in your presence and the presence of each other.
Living Will/Advance Directive
Purpose: A Living Will, also known as an Advance Directive, allows you to express your preferences for end-of-life medical care, such as the use of life support.
Requirements (General): While specific requirements vary by state, it should be in writing and signed by you in the presence of witnesses.
HIPAA Authorization Form
Purpose: A HIPAA (Health Insurance Portability and Accountability Act) Authorization allows you to authorize healthcare providers to share your protected health information with specified individuals.
Healthcare Power of Attorney (Healthcare Proxy)
Purpose: You designate an agent to make healthcare decisions for you if you become incapacitated.
Requirements (Florida): Known as a Designation of Health Care Surrogate in Florida, requires two witnesses.
Durable Power of Attorney
Purpose: You designate an agent to manage your financial and legal affairs if you become incapacitated.
