What the trust actually buys you

Three things a will cannot do on its own. Assets held in the trust pass without probate, so your family is not waiting on a court calendar. A trust is not filed as a public record the way a probated will is. And a trust can hold property for a beneficiary rather than handing it over in one lump sum on their eighteenth birthday.

It also covers incapacity: your successor trustee can manage trust assets if you cannot, without a guardianship petition.

Funding is the part people get wrong

A trust that owns nothing accomplishes nothing. The assets have to be retitled into it — that is called funding, and it is the step most cheap online trusts leave entirely to you. Deeds transferring real property are priced separately and can be handled alongside the trust.

Do I still need a will if I have a trust?

Yes, and the package includes one. A pour-over will catches anything you never moved into the trust and directs it there.

What does funding involve?

Retitling assets into the trust's name — real property by deed, accounts through your bank or brokerage. We tell you exactly what to move and can prepare the deeds as a separate service.

Does a revocable trust save estate tax?
