What estate planning actually is

Estate planning is not one document, and it is not only about death. It is a set of instructions covering two different moments: the years when you are alive but cannot speak or sign for yourself, and everything that happens afterward.

Wills

A will is the instruction that takes effect when you die. It names who inherits what passes through your estate, who administers it, and — for parents — who you nominate to raise your children.

Powers of attorney

A power of attorney is the document that works while you are alive. It is also the one with a hard deadline: it can only be signed by someone who still has the capacity to sign it.

Trusts

A revocable living trust is a container. You move assets into it during your life, you keep full control of it, and at your death what it holds passes to the people you named — without probate and without becoming a public record.

Deeds

A deed changes who owns real property. Which deed you use determines whether the transfer happens now or at death, whether you keep control, and whether the property avoids probate.

Probate

Probate is the court process that transfers what you owned in your sole name after you die. It is not a disaster, but it is public, it takes time, and most of it is avoidable with planning done in advance.
