Deeds and property transfers

Quit Claim Deed

Transfers your ownership interest in a property to someone else without warranting that the title is clean, commonly used for family transfers, divorce settlements, and adding or removing a name from title.

Transfers whatever interest you have in a property, without warranties.

What without warranties means

A quit claim deed passes whatever interest you have, and makes no promise about what that interest is. If there is a lien or a title defect, it comes along with it. That is fine between family members who know the history, and risky between strangers.

Where it fits in an estate plan

Often it is the mechanism for funding a trust, adding a spouse to title, or completing a transfer ordered in a divorce. Getting the deed wrong can create tax and homestead problems, which is why an attorney should look at it before it is recorded.

What's included

More general questions live on the questions page.

Which deed should I use?

It depends on your goal. A quit claim transfers now. A life estate or lady bird deed transfers at death while you keep living there. If you are not sure, book a consultation before anything gets recorded.

Does a deed avoid probate?

Lady bird and life estate deeds can. A plain quit claim deed simply transfers ownership now.
